Shortly after Trump's tweet, D'Souza took his moment in the twitter spotlight to plug his upcoming movie.

Fox News' Judge Andrew Napolitano said the reason Trump "correctly" said D'Souza was treated "unfairly" is that "historically this has not been treated as a criminal prosecution". A pardon would relieve D'Souza of any remaining punishments stemming from his conviction, and would restore certain rights, such as his right to vote.

D'Souza was also sentenced to an eight-hour day of community service every week of the five-year term, weekly counseling, and was ordered to pay a $30,000 fine along with a $100 special assessment.

"President Trump's latest pardon makes crystal clear his willingness to use his pardon power to thwart the cause of justice, rather than advance it", Underwood said in a statement.

On Thursday morning, after Trump announced the pardon, Republican Sen.

D'Souza was born in Mumbai and became a naturalized US citizen in 1991. D'Souza said as much as recently as 2017. One Breitbart News story from 2015 compared his sentencing - he spent eight months in a halfway house and was required to attend counseling in lieu of jail - to Maoism.

D'Souza is a major Trump supporter and has created a number of right-wing propaganda films that help generate conservative conspiracy theories.

A Justice Department spokesperson confirmed Thursday that Trump's pardon of D'Souza did not go through the department's Office of Pardon Attorney.

At issue is Article 40 of the state's Criminal Procedure Law, which, aside from certain exceptions, prevents state prosecution of crimes for which an individual has pleaded guilty or faced jury trial in any other jurisdiction, including federal court.
