Supreme Court nominee Brett Kavanaugh's lips sealed on White House subpoenas, pardons

Democrats have raised concerns that if the special counsel investigation were to make its way to the supreme court, Kavanaugh could not be impartial toward the president who appointed him.

"There is no one in America more qualified for this position and no one more deserving", Trump said in announcing his nomination at the White House. "So sad to see!" This was a 5-4 decision, meaning that similar cases that reach the Court in the future could again be decided by the vote of one justice. Sixty-one were removed from the Senate Judiciary Committee room and charged with disorderly conduct, and nine removed from the second floor of the Dirksen Senate Office Building and charged with crowding, obstruction, or incommoding. "I understand the issue, but as a judge my job as I saw it was to follow the Second Amendment opinion of the Supreme Court whether I agree with it or disagree with it". We can not and should not confirm a justice who believes the president's views carry the day. The Washington Post reports that the hearing, "quickly devolved into a political brawl... as Democrats loudly objected to the proceedings as rushed". Kamala Harris (D-Calif.) while interrupting Grassley, referring to the September 3 release to the committee of 42,000 documents relating to the nominee's work with past administrations.

Sen. John Cornyn of Texas, the No. 2 Republican, accused Democrats of participating in "mob rule", as Durbin proclaimed that the demonstrations were "the noise of democracy". Kavanaugh has produced more records to the committee than any other Supreme Court nominee in history, according to the chairman.

Sen. Ted Cruz, R-Texas, left, speaks with Sen.

Democrats do not have a lot of options to disrupt the confirmation of Brett Kavanaugh to the Supreme Court.

Sen. Richard Blumenthal (D-Conn.) called the hearing a "charade" and "a mockery of our norms". But Kavanaugh's paper trail goes beyond that, as he also worked in the George W. Bush White House and for independent counsel Kenneth Starr during the investigation of President Bill Clinton.

Senate Democrats have vowed a fierce fight to block Kavanaugh's nomination.

On Wednesday, members of the Senate committee were granted up to 30 minutes each to grill Kavanaugh on a variety of subjects. Finally, hours before the hearing, the White House sent 42,000 pages to the committee with instructions that they be kept confidential by senators who viewed them.

Kavanaugh sat, fingers intertwined, quietly staring ahead at the committee members as audience members screamed while being dragged out of the hearing room. There's virtually no change, by comparison, among Republicans, conservatives and white Protestants, evangelical or not. It clearly annoyed and distracted Orrin Hatch (R-Utah). "We shouldn't have to put up with this kind of stuff".

"If the Supreme Court were to adopt your reasoning", she said, "I feel the number of victims would continue to grow". Democrats have attacked the records production on two fronts.

"Letter to SchumerThe letter (pdf) comes from 13 organizations that have spent weeks raising alarm about President Donald Trump's deeply unpopular nominee for the nation's highest court and warning Democrats, particularly Schumer, that there will be consequences in the November midterm elections if they fail to stand united in opposition to Kavanaugh".

If you have the agenda of lashing out against and trying to destroy a qualified Supreme Court nominee because he's conservative and nominated by President Trump, but don't want to get involved personally, it's easy - just hire someone to do it.

Democrats have mobilised heavily to prevent his confirmation.

This link, will get you an analysis by ScotusBlog of the case and Kavanaugh's unusual suggestion of what a president might do with a law that he viewed as unconstitutional, even though it had passed Congress and been signed by a previous president and upheld by the Supreme Court.
