Trump Plans To Use An Executive Order To Suspend The 14th Amendment

  • Trump eyeing an executive order to end citizenship for unauthorized residents' children born in U.S

In an interview with Axios, the president said he plans to issue an executive order challenging how the 14th Amendment is applied to children of undocumented immigrants in the United States.

"The president can not erase the Constitution with an executive order, and the 14th Amendment's citizenship guarantee is clear", said Omar Jadwat, director of the ACLU's Immigrants' Rights Project in a statement Tuesday. It's in the process.

Seeking to end so-called birthright citizenship outlined in the 14th Amendment would take direct aim at the Constitution and likely prompt immediately legal challenges and potential opposition in Congress.

"You can not end the birthright citizenship with an executive order", said Congressman Paul Ryan, Speaker of the U.S. House of Representatives.

Trump, who railed against illegal immigration during the 2016 USA presidential election, has seized on the issue in recent weeks as he seeks to bolster fellow Republicans ahead of next week's contests.

Mana Yegani, an immigration lawyer based in Houston, Texas, told Business Insider, "I think the President will do whatever he wants to please his base". "We're not letting them into this country".

The president's comments to Axios on HBO come amid a renewed push for hardline immigration policies before the midterm elections.

But Trump, in a preview of an televised interview with Axios, claimed, "now they're saying I can do it just with an executive order". Trump dispatched more than 5,000 active-duty military troops to the southern border on Monday as a slow-moving human caravan of around 3,500 Central American migrants, including nursing mothers and children, trekked towards the United States border at least 1,000 miles away. Another, Anton said, is for Trump to sign an executive order telling federal agencies that the children of noncitizens are not citizens.

When the interviewer replied that Trump's assertion is very much in dispute, Trump said: "You can definitely do it with an act of Congress".

It is the latest dramatic development on Mr Trump's war on immigration, with children of non-citizens and illegal immigrants born on U.S. soil now firmly in his sights.

Trump says this "has nothing to do with elections", but his timing is striking.

Pence said Tuesday the administration is looking at action that would revise birthright citizenship, which is guaranteed under the 14th Amendment.

Trump claimed that the USA was unique in granting birthright citizenship.

Revoking birthright citizenship would trigger a legal battle over whether the president has the unilateral power to change an amendment to the Constitution.

What we need for the immigration issue is law that is actually legislated, not another executive order that would probably survive only until we elect the next Democrat to the White House.

Even if the Supreme Court chose to hear arguments, Kanter says court will likely rule the executive order as unconstitutional.

Under the 14th Amendment, citizenship is granted to all people born in the US, even if their parents aren't citizens.

The 14th Amendment was passed by Congress in 1866 after the Civil War and during the period of Reconstruction.
