  • Florida teenager arrested after alleged sexual assault was overheard during video game

A Florida gamer accused of sexually assaulting two girls allegedly paused a game of Grand Theft Auto to rape one of the victims, all while leaving his gaming console's microphone on, allowing a witness to remotely hear the attack.

On June 28, Daniel Enrique Fabian, 18, was in the middle of a game of Grand Theft Auto at his home in Pasco County when he allegedly told another gamer that he was going to "smash" a girl who was over at his house, ABC Action News reported.

A 16-year-old witness told deputies he heard the assault online because Fabian left his mic on during the incident, the newspaper reported.

He has been charged with lewd and lascivious battery- sexual activity with a victim 12 to 15 years of age, according to Pasco Sheriff's records.

A 15-year-old girl alleged that Fabian put his hand over her mouth, pushed her down and raped her before re-joining the online game, WFLA reported.

The other player, who was not named by investigators, reported that Fabian dropped off of the game but left his PlayStation 4 microphone on.

The assault is alleged to have occurred in June at Mr Fabian's home in New Port Richey, western Florida. She said she attempted to stop the incident four times. The girl underwent a rape examination, which confirmed that "medical assessment supports the allegation of sexual abuse". He then began touching her and she stopped him, but he continued, the girl told police. He was being held at the Pasco County Jail without bail.

Fabian was arrested on November 21 and charged with lewd and lascivious battery.
